Plaintiff was injured in a T-section motor vehicle collision. Liability was not substantially contested. Plaintiff sustained transient loss of consciousness upon impact but was alert when EMS arrived on scene. Her physical injuries began to improve early in her recovery but cognitive issues and idiopathic seizures prevented her return to work as a teacher. Allstate tendered its limits of $25,000 early in the litigation, but Plaintiff’s counsel expected a lengthy and expensive discovery process in pursuing the UIM claim. Defense counsel for the UIM carrier appreciated the severity of Plaintiff’s traumatic brain injures relatively early and arranged to tender Geico’s limits many months before trial.
